Terms of Service
These terms apply when you use AquaBrain. By signing in you agree to them. AquaBrain is in private beta — read section 4 carefully.
1. The service
AquaBrain is a personal-knowledge service that captures thoughts, decisions, meetings, and references and makes them retrievable from MCP-aware AI clients and from our web and iOS apps.
2. Who can use it
- You must be 18 or older.
- You must have a valid invite token, issued by an AquaBrain administrator.
- One account per person. Do not share your sign-in link or your Personal Access Tokens.
3. Your content
- You own everything you put in. We claim no ownership of your notes, thoughts, or other captured content.
- You grant us a narrow licence to store, process, and display your content solely to operate the service for you.
- You are responsible for what you capture. Do not put illegal content, other people’s confidential information without permission, or anything that violates a law that applies to you, into the service.
4. Beta status
AquaBrain is in private beta. That means:
- Features may change, break, or be removed without notice.
- We may need to perform maintenance, including outages.
- The service is provided as is, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- Keep your own backups of anything you cannot afford to lose. The web app’s
/extractendpoint exports everything as a single Markdown file at any time.
5. Bring-your-own-key (BYOK)
- AI Skill execution uses your OpenRouter (or other LLM provider) key, configured by you.
- You are responsible for the charges your provider bills you.
- You are responsible for complying with your provider’s terms.
- We do not store or proxy your key beyond the immediate request that requires it.
6. Acceptable use
You will not:
- Attempt to reverse-engineer, scrape, or overload the service.
- Use the service to generate or store content that violates applicable law.
- Use the service to harass, threaten, or harm any person.
- Resell, sublicense, or commercialise the service or its outputs as if they were your own product.
- Interfere with other users’ accounts, including by attempting to access another user’s data.
7. Personal Access Tokens
PATs are bearer credentials. Anyone who has one can act as you. Treat them like passwords. Rotate them if exposed. We may revoke a PAT if we have reason to believe it has been compromised.
8. Suspension and termination
- You may stop using the service and request deletion of your account at any time. See the Privacy Policy.
- We may suspend or terminate accounts that violate these terms, including acceptable use, or that pose a security or legal risk to other users.
- On termination, we will erase your content from primary storage within 7 days; backup copies roll off within 30 days.
9. Pricing
- Trial: $0 for 30 days. No card required. The 30-day period starts when you first use a thought. You can export everything as a single Markdown file at any time. After the trial ends, you can no longer capture new thoughts and are limited to one conversation per day with your saved thoughts unless you upgrade.
- Personal — Monthly: $5 / month. Adds MCP recall in Claude, ChatGPT, Cursor, and Claude Code; Slack capture via reactions and slash commands; the built-in Skills for structured capture and analysis; bulk file import of up to 25 files per job; and bring-your-own OpenRouter key.
- Personal — Annual: $49 / year (saves $11 vs paying monthly). Everything in Personal Monthly, plus priority support during private beta and pricing locked in for the life of your subscription.
Billing is handled by Stripe. Subscriptions renew automatically until cancelled; cancellation takes effect at the end of the current billing period. After a paid subscription ends, your data remains available under the post-trial limits described above (export at any time; one conversation per day with your saved thoughts). Refunds are at our discretion and reviewed case-by-case.
During private beta, invited users keep their existing access at no cost. We will give at least 30 days’ notice by email before changing the price of any plan you are subscribed to.
10. Limitation of liability
To the maximum extent permitted by law, AquaBrain and its operator will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, revenues, data, or use, arising out of or related to your use of the service. Our total liability for any claim is limited to the amount you have paid us in the 12 months preceding the claim, which during private beta is zero.
11. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your content, your use of the service in violation of these terms, or your violation of any law.
12. Changes to these terms
If we change these terms materially, we will email everyone with an active account before the change takes effect. Continued use after the change means you accept the new terms.
13. Governing law
These terms are governed by the laws of England and Wales. Any dispute will be resolved in the courts of England and Wales, unless a mandatory consumer-protection law in your country gives you a different right.
